Terms Of Use
Website Terms of Use
These Website Terms of Use govern your access to and use of gicmd.com, public website content, online forms, quote request tools, contact tools, and related website features operated for GIC Medical Disposal by Greenflow Environmental Services Inc., doing business as Greenflow, GIC Medical Disposal, and GIC-GREEN for Canadian operations, and by GIC-GREEN Inc. for U.S. operations.
By using the website, you agree to these Terms. If you use the website on behalf of a company, facility, institution, agency, or other organization, you represent that you have authority to act for that organization and to provide information on its behalf.
Website terms only
These Terms are website terms. They are not a master service agreement, waste services agreement, business associate agreement, data processing agreement, credit agreement, shipping agreement, hazardous materials transportation agreement, subscription agreement, portal agreement, payment processor agreement, or disposal contract.
Quotes, proposals, service confirmations, work orders, manifests, waste profiles, lab pack documentation, certificates, customer portals, credit approvals, invoices, payment terms, signed agreements, and legally required documents may have separate terms. If those terms conflict with these website Terms, the more specific signed or transaction-specific terms control for that relationship or transaction.
Submitting a website form, clicking a button, starting a chat, uploading information, requesting a quote, or receiving an automated message does not create a service contract, guarantee service availability, reserve capacity, approve a waste stream, or bind us to perform services unless an authorized company representative confirms that in writing or a signed agreement says otherwise.
Who we are
gicmd.com is operated for GIC Medical Disposal by Greenflow Environmental Services Inc., doing business as Greenflow, GIC Medical Disposal, and GIC-GREEN for Canadian operations, and by GIC-GREEN Inc. for U.S. operations. In these Terms, "we", "us", and "our" refer to those operating entities and the applicable brand site you are using.
You can contact us at info@gic-green.com, 1-877-244-8828, or 250 University Ave, 2nd Floor, Toronto, ON M5H 3E5.
No emergency use
Do not use this website, quote forms, chat tools, email forms, or non-emergency contact tools for spills, releases, fire, exposure, urgent health or safety issues, emergency response, regulatory incident reporting, or time-sensitive hazardous conditions. Call emergency services, your internal emergency response team, and the applicable regulator or emergency contact required by law or your safety plan.
No legal, regulatory, safety, medical, or professional advice
Website content is provided for general informational and marketing purposes only. It is not legal, regulatory, environmental, medical, health, safety, transportation, waste classification, packaging, labelling, storage, manifest, tax, accounting, engineering, or professional advice.
You are responsible for getting advice from qualified professionals, reviewing applicable laws and permits, consulting regulators where needed, and confirming service details with an authorized company representative before acting. Do not rely on website content for emergency decisions, compliance decisions, waste classification, packaging, labelling, storage, transportation, disposal method selection, or any decision where incorrect information could create legal, safety, environmental, operational, or financial risk.
Regulated waste responsibility
Unless a signed agreement expressly says otherwise, the generator, customer, facility, or submitting organization remains responsible for proper waste identification, classification, segregation, packaging, labelling, storage, manifesting, documentation, site access, permits, approvals, and compliance with applicable laws. Website content does not transfer generator responsibility, certify a waste stream, approve a disposal pathway, or guarantee regulatory compliance.
We may rely on information you provide when reviewing a request. If information is incomplete, inaccurate, late, misleading, unsafe, or not authorized, we may reject, delay, cancel, reprice, revise, quarantine, or escalate the request, and you remain responsible for resulting costs, delays, regulatory issues, and third-party claims to the fullest extent permitted by law.
Quotes, estimates, and service requests
Online quote requests and service inquiries are invitations to discuss potential services. Any pricing, savings, availability, pickup timing, container recommendation, waste route, service description, "no contract", "no hidden fees", or similar statement on the website is general and subject to confirmation.
Actual service, pricing, taxes, surcharges, minimums, container availability, pickup windows, waste acceptance, disposal method, documentation, permits, vendor capacity, service area, customer eligibility, and credit approval may vary by location, waste type, facility facts, regulatory requirements, operational conditions, and signed terms.
We may accept, reject, revise, withdraw, or condition any quote, request, proposed service, website offer, promotion, or estimate at any time before a binding written agreement or authorized written confirmation is issued. We are not responsible for losses from relying on an unconfirmed estimate, automated message, preliminary recommendation, website calculator, or incomplete inquiry response.
Environmental, compliance, and sustainability claims
Statements about compliance, sustainability, recycling, diversion, treatment, disposal, carbon impact, environmental benefits, tree planting, certifications, reporting, or similar topics depend on the specific service, location, waste stream, documentation, vendor pathway, and applicable law. General website statements do not guarantee a specific environmental outcome, compliance result, diversion rate, recycling status, carbon calculation, certification, or regulatory approval.
Where a specific environmental or compliance claim matters to your organization, ask for written confirmation, supporting documentation, or the applicable certificate or report before relying on it. Nothing in these Terms limits legal obligations that cannot be disclaimed, including obligations related to truthful advertising, safety, environmental compliance, or mandatory consumer or business protections.
User submissions
You are responsible for information, documents, messages, files, form fields, instructions, contact details, waste details, images, and other materials you submit through the website. You represent that your submissions are accurate to the best of your knowledge, complete enough for the purpose submitted, lawful, authorized, and do not violate third-party rights, confidentiality duties, privacy duties, export controls, sanctions, safety requirements, or applicable law.
Do not submit patient names, medical record numbers, diagnosis information, health insurance information, government identifiers, payment card data, passwords, security codes, trade secrets, highly confidential information, or other sensitive information through public website forms unless we specifically request it through an approved channel. If you submit sensitive information anyway, you represent that you have all required rights, authority, consents, and notices, and we may delete, quarantine, restrict, process, or disclose it as reasonably needed to protect the company, route the request, comply with law, or preserve rights.
You grant us a non-exclusive, worldwide, royalty-free license to use, copy, store, process, transmit, disclose, modify, and create operational records from your submissions as reasonably needed to operate the website, respond to inquiries, evaluate or provide services, maintain records, improve systems, prevent abuse, comply with law, and protect rights. This license does not require you to transfer ownership of lawful reviews or feedback.
Accounts, portals, payments, and third-party tools
Customer portals, payment processors, financing tools, chat tools, analytics tools, map tools, social platforms, embedded media, downloadable documents, and third-party websites may be governed by separate terms and privacy notices. We are not responsible for third-party services outside our control, and links or integrations do not mean we endorse or control those third parties.
If you access a customer portal or payment tool, you are responsible for keeping credentials secure, using accurate account and payment information, and following the applicable portal, payment, credit, or customer agreement terms.
Intellectual property
The website and its text, images, graphics, logos, trademarks, service marks, layouts, components, code, downloads, videos, data, and other content are owned by us, our affiliates, our licensors, or our service providers and are protected by intellectual property and other laws.
Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to view the website for your internal informational and service inquiry purposes. You may not copy, scrape, crawl, harvest, reproduce, modify, publish, sell, license, frame, mirror, train models on, create derivative works from, or commercially exploit website content without our prior written permission, except where applicable law expressly permits it.
Acceptable use
You may not use the website to:
- violate law, regulations, permits, sanctions, export controls, privacy rights, intellectual property rights, or third-party rights;
- submit false, misleading, unauthorized, unsafe, confidential, sensitive, malicious, infringing, or unlawful information;
- impersonate another person or organization, misrepresent authority, or interfere with another user, customer, employee, vendor, or system;
- probe, scan, test, bypass, disable, overload, disrupt, reverse engineer, scrape, crawl, harvest, or attack the website or related systems;
- introduce malware, spam, bots, scripts, credential attacks, automated submissions, fake leads, fraudulent activity, or excessive load;
- use website content to build competing datasets, directories, lead lists, machine learning systems, or commercial services without permission;
- interfere with safety, compliance, operations, service routing, security controls, analytics integrity, or legal rights.
We may block, rate-limit, investigate, preserve, remove, report, or take other action against activity we believe violates these Terms, threatens systems or people, creates legal risk, or is otherwise abusive.
Reviews, feedback, and public comments
Nothing in these Terms prohibits you from making lawful, truthful statements about our products, services, or conduct, including honest reviews protected by applicable law. We do not require you to assign us ownership of lawful reviews.
Where we host, display, moderate, or receive feedback, we may remove or decline to publish content that is false, misleading, unlawful, confidential, private, infringing, threatening, harassing, obscene, discriminatory, spam, malware, irrelevant, impersonating, commercially abusive, or otherwise not permitted by the applicable forum rules or law.
Website availability and changes
The website may contain errors, omissions, stale information, broken links, bugs, delays, or unavailable features. We may change, suspend, restrict, replace, or discontinue any website content, route, tool, form, feature, promotion, link, or integration at any time without notice.
We do not guarantee that the website will be uninterrupted, secure, error-free, compatible with every device or browser, available in every location, or free of harmful components.
Disclaimers
To the fullest extent permitted by law, the website and all website content, tools, forms, links, downloads, estimates, and communications are provided "as is" and "as available" without warranties of any kind, whether express, implied, statutory, or otherwise, including warranties of accuracy, completeness, timeliness, availability, non-infringement, merchantability, fitness for a particular purpose, title, quiet enjoyment, security, or results.
We do not warrant that website content is current for your jurisdiction, facility, waste stream, or intended use. No website content, automated response, chat message, email acknowledgement, or preliminary communication creates a warranty, professional duty, fiduciary duty, service obligation, or binding commitment unless a signed agreement or authorized written confirmation expressly says so.
Limitation of liability
To the fullest extent permitted by law, we and our affiliates, owners, directors, officers, employees, contractors, representatives, licensors, service providers, and partners will not be liable for indirect, incidental, consequential, special, exemplary, punitive, enhanced, or similar damages; lost profits; lost revenue; lost business; lost goodwill; lost data; substitute services; business interruption; regulatory penalties caused by your reliance on website content; or losses arising from website errors, downtime, unauthorized access, third-party tools, or unconfirmed quotes, even if advised of the possibility of those damages.
To the fullest extent permitted by law, our total liability for all claims relating to the website or these Terms will not exceed the greater of 100 U.S. dollars, 100 Canadian dollars, or the amount you paid us specifically for access to the website in the three months before the event giving rise to the claim. This limit does not apply where prohibited by law or to liabilities that cannot be limited under applicable law.
Indemnity
To the fullest extent permitted by law, you and any organization on whose behalf you use the website will defend, indemnify, and hold harmless us and our affiliates, owners, directors, officers, employees, contractors, representatives, licensors, service providers, and partners from and against claims, losses, liabilities, damages, judgments, penalties, fines, costs, and expenses, including reasonable legal fees, arising from your website use, submissions, instructions, authority, misuse of content, violation of these Terms, violation of law, infringement or misappropriation of rights, privacy or confidentiality breach, inaccurate waste or facility information, or failure to meet generator, safety, environmental, transportation, documentation, or regulatory responsibilities.
Claims, venue, and governing law
Unless a signed agreement says otherwise or applicable law requires a different result, website claims involving Canadian operations are governed by the laws of Ontario and the federal laws of Canada that apply there, without regard to conflict-of-law rules, and must be brought in the courts located in Toronto, Ontario.
Unless a signed agreement says otherwise or applicable law requires a different result, website claims involving U.S. operations or GIC-GREEN Inc. are governed by the laws of Florida and applicable U.S. federal law, without regard to conflict-of-law rules, and must be brought in the state or federal courts located in Florida.
Where permitted by law, claims relating to the website or these Terms must be brought individually and not as a plaintiff or class member in a class, collective, consolidated, private attorney general, representative, or similar proceeding. Where permitted by law, any claim relating to the website or these Terms must be filed within one year after it arose, or it is permanently barred. These limits do not apply where prohibited by law.
Mandatory rights and jurisdiction-specific limits
Some jurisdictions, including Quebec, California, Florida, Ontario, other Canadian provinces, U.S. states, and federal laws, may limit disclaimers, limitations of liability, indemnities, venue clauses, limitation periods, class waivers, language clauses, electronic contracting terms, or other contract provisions. Nothing in these Terms excludes, restricts, or modifies rights, remedies, warranties, duties, liabilities, notices, language rights, or protections that cannot be excluded, restricted, or modified under applicable law.
If any provision of these Terms is invalid, unlawful, or unenforceable, that provision will be limited or removed to the minimum extent necessary, and the remaining provisions will continue in effect.
International use
The website is operated from Canada and the United States and may not be appropriate or available for use in every jurisdiction. You are responsible for complying with laws that apply to your access, submissions, and use of the website.
Changes to these Terms
We may update these Terms from time to time by posting a revised version with a new effective date. Your continued use of the website after the effective date means you accept the revised Terms, subject to rights that cannot be waived under applicable law.
Assignment, no waiver, and survival
You may not assign or transfer these Terms or website rights without our prior written consent. We may assign these Terms in connection with a merger, acquisition, financing, reorganization, sale of assets, change of control, or transfer of website operations.
Our failure to enforce a provision is not a waiver. Provisions that by their nature should survive termination or website use will survive, including intellectual property, submissions, disclaimers, limitation of liability, indemnity, governing law, venue, claim limits, and mandatory-rights provisions.
